These terms and conditions have therefore been set as the starting point for providing all services available through the Mogo app, and they form an integral part of the consumer finance contract you have signed.
These terms and conditions also set out all information about your obligations and rights and how to exercise them, as well as the personal data we hold about you. If any of these terms becomes invalid or unenforceable for any reason, this shall not affect the validity and enforceability of the remaining terms.
Who is Mogo
- MID Bank Consumer Finance Company "Mogo" (S.A.E.) is the owner of this app. It is licensed to carry out consumer finance activities in accordance with Law No. 18 of 2020 regulating consumer finance activities, registered under Commercial Register No. 251075, Tax Card No. 283-384-669, and Financial Regulatory Authority licence No. (32) dated 17/4/2022. You can contact us directly through our customer service representatives (17040) or by email at contact-us@mogo-eg.com
- We are committed to protecting your privacy and personal data, and we take our responsibility to keep your personal data safe and confidential seriously.
- You acknowledge and agree that all information and data sent to the mobile app or the online portal will become the exclusive property of Mogo with no right to recover it at any time, including but not limited to applications, documents, comments and collective suggestions. You may not use a misleading or anonymous email address, impersonate another person, or mislead us or any third party regarding your information or the files you submit.
- Please be careful and cautious when providing personal or confidential information. Mogo fully disclaims any form of fraudulent communication. Mogo will never ask you for the one-time password (OTP) sent to your personal phone number, or for any confidential information, except through its digital platforms or its customer channels, including call centres, customer service and activation points. Please do not respond to any phone calls, text messages or social media messages asking you to share or disclose your confidential information.
- Accordingly, the customer acknowledges and agrees that using the Mogo app and entering the OTP (one-time password) to complete a purchase constitutes acceptance of all terms and conditions and the repayment method, and completion of the purchase. The customer thereby becomes indebted to Mogo for the value of the transaction and its associated charges, as well as any previous transactions made by the customer.
General provisions
- The company is not responsible for any fees collected by any party other than the fees announced on the app, as registration and activation on the consumer finance app are free of charge.
- The company has the right to accept or reject an application to register for the consumer finance app services at its sole discretion and without any liability on the company in all cases.
- The company is not responsible for any disagreements or disputes arising between the customer and the merchant regarding products and services financed through the consumer finance app, and the company is not a party to those relationships.
- The customer may apply to return products to the merchant within the permitted period from the date of purchase in accordance with the Egyptian Consumer Protection Law. Accepting the return is solely the merchant's responsibility in accordance with the merchant's exchange and return policies, without violating the Egyptian Consumer Protection Law. It is agreed that if a product return results in a reduction of the financing granted by MID Bank Consumer Finance, the company may require the customer to immediately repay the financed amount and the interest due on it, as an exception to the financing period in force under this contract.
- The company is not responsible for any establishment refusing to complete purchases using the consumer finance app, or for any defect in the products or services financed by the company. No claim by the customer against the merchant shall be a claim against the company, and the company will add any refunded amount to the customer's available limit only after receiving a properly issued approval of the return request from the merchant.
- The company, or any other party it engages to carry out any of its obligations under the terms and conditions of using the consumer finance app set out in the consumer finance contract, may record phone calls received on the customer service number and keep them, and such recordings shall be conclusive evidence against the customer.
- The company may at any time terminate the activation of the consumer finance app without prior notice to the customer or giving reasons. This does not affect the validity of the consumer finance contract for the customer's financing transactions made on the app before its deactivation.
- The company reserves the right to amend any of the terms and conditions of the consumer finance app and/or the consumer finance contract.
- The company reserves the right from time to time to amend the fees and interest rates applied to the service without objection from the customer, provided that the amended rates apply only to subsequent financing transactions and that the customer is notified of the amendment by any means used by the company.
- If a transaction made using the consumer finance app is suspected, company staff will call the customer on the previously registered numbers to review the transactions. If the company cannot reach the customer, it reserves the right to temporarily suspend the consumer finance app to protect the customer from the risks of theft or fraud.
- The customer is entitled to obtain financing through the consumer finance app and through the digital platforms on which the app is available, and in doing so is bound by the terms and conditions of those platforms without any liability on the company.
- The products and services that the company may finance are limited to those set out in Consumer Finance Law No. 18 of 2020 or in decisions issued by the Authority's Board of Directors.
- The customer can view the details of all consumer finance transactions they have made by logging into their account on the app, including the available limit, the financed amount, the financing period, and the number, due dates and amounts of the monthly instalments.
- The customer is absolutely and unconditionally responsible towards the company for all fees and obligations arising from using the consumer finance app, as well as the consequences of misuse or loss of the customer's mobile phone.
- Using the consumer finance app to complete the financing of product purchases constitutes the customer's full acceptance that they have fully inspected the financed products, after examining and testing them, in a manner that removes any uncertainty, in all cases and regardless of whether the products are received at the time of financing. The customer therefore has no recourse against the company if the products have a manufacturing or hidden defect, and shall instead have recourse against the manufacturer, importer or seller of the products or services.
- When using the consumer finance app to finance the purchase of products and services, the customer becomes indebted to the company for the financed value in monthly instalments due on the first day of each month according to the financing plan chosen by the customer on the app. If the customer fails to pay these instalments by the fifth day from their due date, the company may impose a monthly late fee of 10% of the unpaid instalments, added to the unpaid instalments, and the total of the instalments and the fee becomes due on the next monthly instalment date.
- The customer may make full or partial early repayment with repayment fees not exceeding 15% of the amount due. The company may change its early repayment policy for some transactions linked to special offers, and may enable or cancel the early repayment feature at any time.
